Can You Drink in a Limo in Ontario? 2026 Law Explained

Can You Drink in a Limo in Ontario? 2026 Law Explained

"In Ontario, it is generally illegal to consume alcohol in a limousine unless specific licensing or permit requirements are met. The Liquor Licence and Control Act, 2019 prohibits open alcohol in motor vehicles, and physical partitions do not provide a legal exception for passengers to drink while in transit."

Every movie gets it wrong. The limousine slides up to the curb, the door opens, and somebody inside is already holding a flute of champagne as if it came with the seat.

In reality, Ontario law has rather more to say about the matter. It’s usually less glamorous and a good deal more legislated.

At Vista Limo Rental in Brampton, Ontario, we’ve fielded this question from brides, birthday groups, and anxious best men for more than 25 years, usually about five minutes before a booking is confirmed.

Here’s what the law actually says – what it allows and doesn’t, and which details are worth checking before your ride.

The Short Answer

In most cases, no. You can’t simply uncork a bottle and start drinking in a limousine on Ontario roads unless the relevant licensing or permit requirement authorizes it.

Whether alcohol may be consumed depends on the applicable legal authorization and the circumstances of the booking.

What the Law Actually Says

Ontario’s rules are a tad less cinematic and don’t really promise the champagne-in-the-back-seat scene.

The rules are set by the Liquor Licence and Control Act, 2019. Section 41(1) establishes the general principle: liquor cannot simply be possessed or consumed wherever one pleases.

Outside of a residence, licensed premises, or any other place that law permits, the restrictions apply. For a limousine travelling along a public road, that distinction matters.

Section 41(2) makes an exception for possession of liquor in a closed container. That does not mean passengers can open it and drink in a limousine.

Section 42 applies whether a motor vehicle is moving or parked. It prohibits a person from driving or having care or control of a vehicle containing liquor unless the liquor is carried under the authority of a licence or permit, is in an unopened container with its seal intact, or is packed in baggage that is fastened closed or otherwise not readily accessible to anyone in the vehicle.

So, a sealed bottle of Niagara Riesling riding quietly in the vehicle is one thing. A bottle with the cap cracked, with passengers drinking from it, is another.

The penalties are serious and worth understanding.

The Act allows fines of up to $100,000 for an individual and $250,000 for a corporation, while certain offences can also carry the possibility of imprisonment. However, those are maximum penalties, not necessarily what someone would face in an ordinary roadside stop.

A licence or permit should be more than a verbal assurance. Ask the operator to explain which authorization applies to your booking.

“But There’s a Partition”

You will find websites claiming that a glass divider between driver and passengers changes the answer.

That’s a statement you shouldn’t accept at face value. The Act itself doesn’t mention partitions.

A partition does not, by itself, create an exception to section 42 or authorize passengers to consume alcohol.

If a company tells you that the divider makes all the difference, ask them to show you the legal basis in writing. Check the relevant AGCO guidance, too.

Who Actually Gets the Ticket

Everyone shares the risk, but not equally.

Under section 42, the driver, or whoever has care or control of the vehicle, can face consequences if liquor is unlawfully present in the motor vehicle – be it parked or moving.

Passengers may also be charged under section 41(1) for having or drinking it.

A company, and in some circumstances its officers, can face liability too.

That is why a professional chauffeur may politely refuse a wedding party’s request to pop the cork in the back seat. It isn’t about spoiling the fun. It is job security.

Also remember age. Ontario’s legal drinking age is 19, and a licence or permit doesn’t change that.

How to Have the Party and Stay Legal

The rules may put a few limits on the plans, but they don't have to spoil the occasion. A few simple choices can help keep the celebration on track:

Start where it’s legal. A pre-party at a home or hotel suite is one of the best ways to get started. For a rented hall, check that it holds a licence or permit before you make the plans. Then ride to the main event.

Let the bottle wait. Even at a licensed venue, check its own rules on outside bottles before you open anything.

Drink at destinations built for it. Licensed wineries, restaurants, breweries, and banquet halls offer a place to enjoy a drink where the appropriate authorization permits it. If you’re heading into Niagara wine country, the tasting room is where the pouring happens, and the limousine’s job is getting you there and back. (Our Niagara wine tour limousine service walks through how.)

Toast at the venue. Whether you’re celebrating a wedding, a birthday, or simply a good day out, wait until you reach a place where drinking is permitted. The photographs will be better for it, too.

Questions to Ask Any Limo Company Before You Book

What licence or permit, if any, authorizes alcohol possession or consumption for this booking? Can I see the relevant documentation?
What is your policy on sealed bottles and BYO?
Who is responsible if a passenger breaks the rules mid-trip?
Will you end the trip early if alcohol is opened? (Ask this one twice.)

A company that answers confidently has done the homework. A company that waves you off with “it’s fine” hasn’t.
